Toprol XL® or its Generic

You Could Get Money from a Class Action Settlement

A Settlement has been reached in a class action lawsuit regarding the price of the heart medication, Toprol XL® and its generic, metoprolol succinate.  AstraZeneca AB, AstraZeneca LP, AstraZeneca Pharmaceuticals LP, and Aktiebolaget Hassle (the “Defendants” or “AZ”) will pay up to $11 million into a Settlement Fund. No one is claiming that Toprol XL® or metoprolol succinate are unsafe or Ineffective.

You are included if you or your company purchased, paid for and/or reimbursed others for Toprol XL® or its generic equivalent at any time from May 5, 2005 through September 27, 2012.  Purchases made directly from the Defendants are not included under the Settlement.  The Settlement includes consumers, as well as third-party payers such as insurers and employee welfare benefit plans. "PURCHASED"  in this case means you paid all or a part of the cost of the drug, e.g., via a co-payment.

However, if you still wish to file a claim, you should do so as soon as possible. Your claim will be marked as "late" and ultimately the court will decide whether or not to accept it as eligible for payment.

Consumer Class

Consumers who paid any amount for Toprol XL® or its generic, including co-pays and co-insurance, generally are included in the Settlement.  All persons throughout the United States and its territories who purchased, paid for and/or reimbursed others for Toprol XL® or its generic equivalent metoprolol succinate, intended for consumption by themselves, their families or their members, employees, plan participants, beneficiaries or insureds at any time from May 5, 2005 through September 27, 2012. 

Third-Party Payors

Entities known as “Third-Party Payors” (“TPPs”) are also included in the Class.  TPPs could include health insurers that paid all or part of the cost of Toprol XL® or its generic for their members, employees, insureds, participants, or beneficiaries.  This may also include third-party administrators, health maintenance organizations, self-funded health and welfare plans that paid some portion of the cost of Toprol XL® or its generic for employees or family members of employees insured under these plans.  Entities with self-funded plans that contract with a health insurance company or other entity to serve as a Third-Party claims administrator to administer their prescription drug benefits, qualify as TPPs.  You are a member of the Class if you fit the definition below:

All persons or entities throughout the United States and its territories who purchased, paid for and/or reimbursed others for Toprol XL® or its generic equivalent metoprolol succinate, intended for consumption by themselves, their families or their members, employees, plan participants, beneficiaries or insureds at any time from May 5, 2005 through September 27, 2012.
